Alyrica strives to provide consumers with accessible, easy-to-understand information.
This Service Terms and Conditions Agreement ("Service Agreement") is entered into between Alyrica Networks, Inc. ("Alyrica") and the individual or entity ("Customer") named on the Customer Order Summary (COS) and sets forth the terms and conditions under which Alyrica will make available its Service. This Service Agreement governs both home and commercial Customers.
By using the Service, Customers agree to be bound by the terms of this Service Agreement. If you do not agree, do not use the Service.
A one-time installation fee applies to all new service installations. Alyrica technicians will install all necessary equipment at the service address. Equipment provided by Alyrica remains the property of Alyrica. Customers are responsible for maintaining equipment in good working condition and must not tamper with or modify Alyrica-provided equipment.
Customer is responsible for maintaining an appropriate environment (power, physical protection) for Alyrica equipment. Alyrica's limited one-year warranty covers defects in materials or workmanship in Alyrica Equipment, but does not cover damage caused by misuse, neglect, or failure to follow Alyrica's guidelines.
Monthly service fees are billed in advance. Payment is due on the date specified in the COS. Alyrica reserves the right to suspend or terminate service for non-payment. Prices are subject to change with appropriate notice as specified in the COS.
Customers may not use the Service to:
Alyrica may block traffic or terminate service if a Customer violates these acceptable use requirements.
Alyrica's Privacy Policy is incorporated into this Agreement by reference. Alyrica may monitor network traffic to maintain service quality and comply with legal requirements.
ALYRICA'S LIABILITY FOR ANY CLAIM ARISING UNDER THIS AGREEMENT SHALL BE LIMITED TO THE MONTHLY SERVICE FEE PAID BY CUSTOMER IN THE MONTH THE CLAIM AROSE. ALYRICA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR DATA. ALYRICA IS NOT LIABLE FOR SERVICE INTERRUPTIONS BEYOND ITS REASONABLE CONTROL.
Either party may terminate this Agreement upon notice as specified in the COS. Alyrica may terminate immediately for violation of this Agreement, non-payment, or illegal use of the Service. Upon termination, Customer must return all Alyrica equipment in good working condition.
This Agreement is governed by the laws of the State of Oregon. Any disputes shall be resolved in the courts of Benton County, Oregon.
